The WizardThese Terms & Conditions (“Terms”) govern your access to and use of jakethewizard.com and related pages (the “Site”), operated by Jake Tlapek (“Jake,” “I,” “me,” or “the Operator”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Use of the Site
You may use the Site for lawful purposes only. You agree not to:
- Use the Site in any way that violates applicable law or regulation.
- Attempt to gain unauthorized access to the Site, its servers, or any connected systems.
- Interfere with or disrupt the Site, including by introducing malware or overloading infrastructure.
- Scrape, harvest, or collect information about other users, or copy the Site’s content except as permitted below.
Intellectual property
Unless otherwise noted, all content on the Site — including text, graphics, logos, illustrations, the “Eight Dominoes” framework, photographs, and the overall design — is owned by Jake Tlapek or licensed to me and is protected by intellectual-property laws. You may view and share the content for personal, non-commercial purposes. You may not reproduce, republish, sell, or create derivative works from it without my prior written permission.
Not professional advice
The content on the Site is provided for general informational and educational purposes. It is not legal, financial, tax, or other professional advice, and it does not create an advisor-client relationship. Marketing results vary; nothing on the Site is a guarantee of any particular outcome, revenue, or result. You are responsible for your own business decisions.
Consulting, bookings, and products
Engagements such as consulting sessions, audits, retainers, memberships, books, or other products or services are governed by the specific terms, pricing, and scope provided to you at the time of purchase or booking. Those engagement-specific terms control if they conflict with these Terms. Submitting a form or inquiry does not create a binding agreement; an engagement begins only once expressly confirmed in writing.
Third-party links and services
The Site links to and embeds third-party websites and services (for example, scheduling, payment, social, and video platforms). I do not control and am not responsible for the content, policies, or practices of those third parties. Your use of them is governed by their terms.
Disclaimer of warranties
The Site is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. I do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, Jake Tlapek will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Site. To the extent liability cannot be excluded, my total liability for any claim relating to the Site is limited to USD $100.
Indemnification
You agree to indemnify and hold harmless Jake Tlapek from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Site or your violation of these Terms or any applicable law.
Governing law
These Terms are governed by the laws of the United States and the State of Arizona, without regard to conflict-of-law principles. You agree that any dispute arising from these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Arizona, unless applicable law requires otherwise.
Changes to these Terms
I may update these Terms from time to time. When I do, I will revise the “Last updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
